Installation Agreement
Invictus Floor Coatings LLC
Thank you for the opportunity to work with you and for choosing Invictus as your epoxy floor coating specialist. The following is the agreement between the “customer” and Invictus Floor Coatings LLC, the customer will be addressed as “customer” and “owner”.
Important Points for the Customer to Know
- Epoxy dries extremely quickly, the reason why its so important to get a floor coating done by professionals is because epoxy can dry before you get it down on the floor and it can dry unevenly.
- While workers are grinding the concrete please stay away from the area, the concrete dust is toxic, and the heavy machinery is dangerous.
- The smell of wet epoxy is very strong and can cause harm. We will help you the best we can to handle the smell and keep it out of your living space, although if you are sensitive to strong smells let us know and we can use a less toxic smelling product.
DESCRIPTION OF WORK: The description of the flooring we are installing for you and the date of installation is detailed on your Invoice. By signing below, you are indicating that you have reviewed the Invoice closely and that the details are all correct. In the case that we make a mistake and forget to include something that you wanted please contact your project manager that gave you your quote.
PAYMENT: Payment shall be made to Invictus Floor Coatings LLC at 11560 s state St. Draper Utah 84020. We accept cards, cash, and bank transfer. When you pay with cash or a bank transfer you save 3% on your floor.
By signing below, you agree to pay Invictus Floor Coatings by one of the three methods mentioned above. Payment discount terms include a 0 percent discount if the bill is paid within 30 days. If any invoice is not paid when due, interest will be added to and payable on all overdue amounts at 10% per month or the maximum percentage allowed under applicable laws, whichever is less. You shall pay all costs of collection, including without limitation, reasonable attorney fees.
In addition to any other right or remedy provided by law, if the customer fails to pay for the services when due, Invictus Floor Coatings has the option to treat such failure to pay as a material breach of this contract and may cancel and/or seek legal remedies.
TERM: Invictus Floor coatings LLC holds the power to terminate this contract at any time.
INSURANCE: Invictus Floor Coatings has general liability insurance, workers compensation, and commercial auto insurance.
MOVING ITEMS: Invictus Floor Coatings offers help moving items, they will spend maximum 2 hours helping the homeowner clear out their space before they start work. The owner or an owner’s representative with at least 18 years of age must be present while moving items and must actively help employees know where their items will be placed and in what manner. Employees of Invictus Floor Coatings will not lift objects more than 200 pounds, they will not carry any items further than 100 feet, they will not lift anything that they see to be unsafe or too fragile to handle, they will not carry items more than one flight of stairs. Any damages done to the building or to the objects being moved during the clearing out process are not the liability or responsibility of Invictus Floor Coatings, as they are not a moving company and will not be held to such expectations. Invictus Employees will only help remove things from the area and will not put them back or organize the belongings of the customer. OUR INSTALLERS ARE CAREFUL WHEN MOVING ITEMS, HOWEVER ALL ITEMS ARE MOVED AT THE CLIENT’S OWN RISK.
ELECTRONICS & ELECTRICAL FEATURES:
- Our installers do not unhook or re-hook any electronic equipment.
- Our installers do not unhook or re-hook any appliances that are hardwired. You will need to hire an electrician to do so.
- Our installers do not deconstruct or construct stairs or any framed object such as and not limited to stairs and storage shelves.

Warranty
Invictus Floor Coatings shall provide its services and meet its obligations under this contract in a timely and workmanlike manner, using knowledge and recommendations for performing the services which meet generally acceptable standards in Invictus Floor Coatings’ community and region, and will provide a standard of care equal to, or superior to, care used by service providers similar to Invictus Floor Coatings on similar projects.
All customers must understand that concrete cracks, moves, and breaks. Invictus floor coatings does beautiful work and they install strong floor coatings although, they cannot guarantee that what is underneath the coating will be strong and last. By signing this the customer is confirming that they understand that the integrity of their concrete is not the liability of Invictus floor coatings and if it breaks, shifts, cracks, and/or losses its integrity for any reason Invictus Floor Coatings is not liable.
Invictus Floor Coatings, its employees and its owner are not liable for any bodily injury in or near the job-site while work is being performed or after work is complete. All customers should understand that wet floors and uncured epoxy are slippery and should never be walked on. Customers of Invictus Floor Coatings must decide which color they want during the quotation process, pervious to the job start date. When the work is complete, and in the case that the customer is unhappy with the color they chose in the quotation process, Invictus Floor coatings holds no responsibility, in this case, the customer must buy a new floor and begin the quotation process again.
The following are liability’s that the customer has, they should be read and understood. The customer and an Invictus representative will speak to decide how they wish to rectify any problem that may occur, after something occurs then the customer may be charged to rectify the issue.
Invictus Floor Coatings has a strict no refunds policy.
- Acts of god including and not limited to strikes, labor shortages, material shortages, natural disasters, etc.
- All work in addition to the scope of work shall be considered extra work and contractor shall be fairly compensated for the same at contractors’ standard rates. When extra work is needed, the project manager will give the customer a quote for the needed work and it will be treated as though it is a separate job. With separate invoices.
- Unforeseen labor will be paid for by the owner at $75.00 per hour per employee.
- Invictus Floor Coatings will not put the customer on their schedule nor order materials until they have a signed contract and a 50% deposit.
SEVERABILITY: If any provision herein should, for any reason, be construed by a court of competent jurisdiction to be invalid or unenforceable, all other provisions shall remain in full force and effect and be construed so as to make this Agreement enforceable to the maximum extent allowed by law.
CANCELLATION: The customer has 48 hours after the initial payment has been made to exercise their right of rescission. On the day agreed upon of which Invictus Floor coatings will start work, the customer loses their right to recession. All sales are final.
Miscellaneous Terms
Invictus Floor Coatings will do their best to refer a third-party resource that the customer can use in order to rectify what has happened. Invictus Floor Coatings will have systems in place to help avoid any of these things from happening although holds no liability in the following cases:
- Electrical failures during work in the buildings surrounding the work site including tripped circuit breakers and power outages.
- Injury occurred when a person enters the work site or touches any equipment.
- A third party person/animal/wind/object or anything of that nature touches drying epoxy
- When a car is driven, or a person walks on the curing epoxy prematurely.
- Faulty concrete or concrete overlays that are chipping, cracking, pealing up or doing things or that nature, we do not advise anyone to epoxy coat a weak concrete floor with epoxy. Our coatings are designed to protect concrete, not fix pitted or spalled concrete.
- When epoxy ignites due to its flammability. When wet, epoxy is extremely flammable It is the customers responsibility to keep flames away from the work area.
- Customers health problems caused by toxic concrete dust. While crews are working, customers and all other persons are expected to stay out of the work area. Invictus floor coatings will provide a safe breathing environment for people outside of the work area, although customers are asked to stay out of all work areas to avoid breathing concrete dust.
- Damage done to the owner’s property due to dust.
- Damage done by strong epoxy smell
- When crews are not able to work due to bad weather conditions and it changes when the dates of work are forced to change.
- When using a credit card, a 3% fee is added to the total cost of job, this is not included when the customer pays using a bank transfer, cash or a check.
- When additional unforeseen materials and labor are needed the install team manager will speak to the customer and discuss the price of the unforeseen costs of work. If the customer is unable or unwilling to discuss those options with the job manager, Invictus Floor Coatings will proceed by making the decision how they see best fit after leaving a message with the customer, then will bill the customer for the full price of required materials and work.
- When the customer backs out and/or changes what products and services they want, they will not be reimbursed for any payments they have made.
